Terms & Conditions

These Terms & Conditions apply to all kitchen design, consultation, measuring, ordering support, and project management services provided by Kaya Gorska (“we”, “our”, “us”). By booking our services, you (“the Client”) agree to the terms outlined below.
1. Our Services
We provide residential kitchen design services, which may include:

Initial consultations
-
Space planning and kitchen layouts
-
2D and 3D visual designs
-
Technical drawings and elevations
-
Measuring services
-
Ordering support
-
Project management and coordination
-
Design revisions
The exact scope of services will be agreed with the Client before work begins.
2. Booking & Payment
Full payment is required prior to any consultation, site visit, measuring appointment, meeting, or design work commencing.
Bookings are not confirmed until payment has been received in full.
Payments are non-refundable once work has commenced, including consultations, design development, drafting, revisions, or site visits. We reserve the right to pause or withhold work where payment has not been received.
3. Design Process
Following the initial briefing meeting, we will prepare a draft design based on the information provided by the Client.
Once feedback has been received and the design approved, a final design package will be issued which may include:

Floorplans
-
Elevations
-
Technical drawings
-
3D visuals
-
Notes for installers or trades
All drawings and visuals are indicative and should be checked by installers and contractors prior to installation or ordering.
4. Design Revisions
Each design package includes up to two revisions.
Additional revisions, redesigns, layout changes, or amendments requested beyond the included revisions will incur additional charges. These charges will be confirmed prior to further work being undertaken.
5. Measurements & Site Information
Where the Client provides measurements, dimensions, photographs, plans, or other site information, we will rely on the accuracy of the information supplied. We cannot accept responsibility or liability for any errors, omissions, additional costs, fitting issues, or delays resulting from inaccurate measurements or information provided by the Client or third parties.
Clients remain responsible for ensuring all supplied information is accurate and up to date.
6. Site Measuring Services
Where we carry out site measurements ourselves, measurements will be taken with reasonable care and skill.
However, final site dimensions, appliance specifications, plumbing locations, electrical positions, structural requirements, and installation tolerances must always be checked and confirmed by the Client’s fitter, installer, contractor, or relevant tradesperson prior to ordering or installation. We are not responsible for site alterations, building irregularities, or unforeseen issues discovered during installation.
7. Ordering & Product Responsibility
Any ordering assistance or product recommendations provided are advisory only.
The Client is responsible for:

Reviewing all orders before purchase

Checking quantities, finishes, colours, and specifications
-
Ensuring products are suitable for their space and installation requirements
We cannot be hold responsible for supplier errors, manufacturing defects, discontinued products, delivery delays, or third-party installation issues.
8. Project Management Services
Where project management services are provided, we will coordinate and assist throughout the project to the best of our ability.
However, we are not responsible for:

The workmanship or performance of third-party contractors or trades
-
Delays caused by suppliers, installers, or external contractors
-
Structural, plumbing, electrical, or building works
-
Costs arising from third-party errors or delays
Any agreements with builders, installers, contractors, or suppliers remain solely between the Client and the relevant third party.
10. Intellectual Property & Marketing
All drawings, designs, layouts, visuals, renders, and design documents produced by us remain the intellectual property of Kaya Gorska. Upon full payment, the Client is granted a non-exclusive licence to use the designs solely for their individual residential project. Designs, documents, and visuals may not be copied, reproduced, shared with other designers for commercial reuse, resold, or used for any other purpose without prior written permission.
We reserve the right to use design work, 3D visuals, renders, and — with the Client’s permission — photographs of completed projects for marketing purposes, including use on our website, portfolio, and social media platforms.
11. Limitation of Liability
To the fullest extent permitted by law, our liability in relation to any claim arising from our services shall be limited to the total amount paid by the Client for the relevant service.
We shall not be liable for:

Indirect or consequential losses

Installation costs
-
Delays
-
Loss of profit
-
Third-party contractor errors
-
Supplier or manufacturing issues
Nothing in these Terms excludes liability where it would be unlawful to do so under UK law.
12. Data Protection & Confidentiality
Any personal information provided by the Client will be handled in accordance with applicable UK data protection laws.
Client information will not be shared with third parties except where necessary to provide services, place orders on the Client’s behalf, or where required by law.
Project files and client data may be retained for administrative and record-keeping purposes and will typically be deleted 12 months after completion of the project unless otherwise agreed.
13. Cancellation & Rescheduling
If the Client cancels after work has commenced, payments made are non-refundable.
We request at least 48 hours’ notice for rescheduling appointments where possible.
We reserve the right to refuse or cancel services at our discretion.
14. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
